The following Sweepstakes is intended for play in the United States only, and shall only be construed and evaluated according to U.S. law. Do not enter this Sweepstakes if you are not located in the U.S. at the time of entry.
1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. The “Chance to WIN $100,000” Sweepstakes ("Sweepstakes") is open and offered only to legal residents of the 50 United States and Washington D.C., who are 18 years of age and older as of June 11, 2008. Sweepstakes starts at 12:01 a.m. EDT on June 11, 2008 and ends at 11:59 p.m. PDT on September 9, 2008 ("Sweepstakes Period").
All entries, whether submitted in-store or by mail, (as described below) have an equal chance of winning. Employees and their immediate families (parent, child, sibling or spouse) and/or household members of each (whether related or not) of Charming Shoppes of Delaware, Inc. ("Sponsor"), their respective parents, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies and any other persons or entities associated with this promotion are ineligible to enter or win. By participating, you agree to abide by and be bound by these Official Rules. Void in Puerto Rico, all U.S. territories and possessions, overseas military installations and where prohibited by law.
2. TWO WAYS TO ENTER:
A). To Enter at Participating Lane Bryant Stores: Participants will be automatically entered into the Sweepstakes by using a participating stores “Chance to WIN $100,000” coupon and completing the official Sweepstakes entry form found on the reverse side between June 11, 2008 and September 9, 2008. ALL IN-STORE ENTRIES MUST BE RECEIVED BY STORE CLOSING ON SEPTEMBER 9, 2008.
B). To Enter By Mail: To enter by mail, without purchase or obligation, send your name, address, city, state, zip code and day and evening telephone numbers with area code hand-printed on a 3-1/2" x 5"piece of paper. On the reverse side of the 3-1/2" x 5" paper hand-print “Chance to WIN $100,000.” In addition, mail your completed Sweepstakes entry in a hand-addressed stamped envelope to: “Chance to WIN $100,000” Sweepstakes, 90 Rockwood Place, Rochester, NY 14610 ("Mail Entry"). Mail Entries must be postmarked by September 9, 2008 AND RECEIVED BY SEPTEMBER 15, 2008. Limit of one (1) entry per person, per day, per envelope/or mailing address accepted for this Sweepstakes. Sponsor is not responsible for lost, late, incomplete, illegible, stolen, misdirected, mutilated, delayed, destroyed or postage due entries. Incomplete information may result in disqualification of entry. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. No mechanical reproductions or facsimiles of entries allowed. Entries become property of Sponsor and will not be returned.
3. PRIZE DETAILS AND ODDS OF WINNING:
One (1) Grand Prize winner will receive $10,000 cash and a chance to win an additional $90,000 cash award. The Grand Prize winner will participate in a chance-based game to determine if he/she will win the additional $90,000 Cash. The Grand Prize winner will be invited to select and remove two (2) envelopes from fifteen (15) sealed envelopes mounted to a board. Two of these 15 envelopes contain a certificate for the $90,000. In order to win, both winning envelopes must be selected. The winning envelope will be revealed if not selected by the winner. The odds of winning the additional $90,000 are 1 in 105 for the finalist.
Odds of winning are based upon the number of eligible entries received.
4. DRAWING AND AWARDING OF PRIZE(S): One (1) Grand Prize Winner will be selected in a random drawing from among all eligible entries received, to be conducted on or about September 23, 2008 by Sponsor, or authorized representative of Sponsor, whose decisions are final on all matters relating to this Sweepstakes. Winner will be notified by e-mail, mail and/or phone, and will be required to complete and execute an affidavit of eligibility/compliance/liability release, and, where lawful, a publicity release, to be returned within 14 days of the date notice is sent. Failure to return all required paperwork within this stated time period may result in the forfeiture of the prize and an alternate winner will be selected. The prize will be awarded assuming a sufficient number of eligible entries are received. Prize returned as undeliverable or otherwise not claimed within fourteen (14) days after delivery of notification will be forfeited and awarded to an alternate winner. Prizes cannot be substituted, except as provided herein. Sponsor reserves the right to substitute Prize with one of equal or greater value should feature Prize become unavailable. The Prize is not transferable and may not be exchanged for other prize. All federal, state and local taxes are sole responsibility of the Grand Prize winner.
5. GENERAL:By accepting a Prize, where permitted by law, Winner grants to the Sponsor, its respective parents, subsidiaries and related companies, and those acting pursuant to the authority of Sponsor (which grant will be confirmed in writing upon Sponsor's request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time the Winner's full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. IN NO EVENT WILL SPONSOR, THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, DEALERS, DISTRIBUTORS,SUPPLIERS, PRIZE PROVIDER AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION OR INABILITY TO PARTICIPATE IN THIS SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES. By participating, entrants release and agree to hold harmless the Sponsor, their respective parents, affiliates, subsidiaries, advertising and promotion agencies, dealers, distributors, suppliers, Prize provider and their respective directors, officers, employees, shareholders, representatives and agents from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Sweepstakes or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize(s). Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error, which may occur in the processing of the Sweepstakes entries. Sponsor is not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the Sweepstakes. Sponsor is not responsible for late, lost, stolen, misdirected or mutilated entries or postage due mail. Any personally identifiable information collected during an entrant's participation in this promotion will be collected by Sponsor and used by, its respective parents, its affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Sweepstakes and for marketing purposes as described in these Official Rules and in accordance with Sponsor's Privacy Policy as stated at http://www.lanebryant.com/pagebuilder/privacy_policy. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE CO-SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Sweepstakes, and randomly award the Prizes from among all eligible entries received as of such date should fraud, virus, bugs or other causes beyond the Sponsor's control corrupt the administration, fairness, proper play or security of the Sweepstakes. Sponsor reserves the right, at its sole discretion, to disqualify any individual (and all of his/her Sweepstakes entries) who tampers with the entry process. This Sweepstakes is subject to all applicable federal, state and local laws and regulations. The interpretation of these Official Rules shall be governed by the laws of the Commonwealth of Pennsylvania. Any and all disputes will be individually resolved, without resort to class action, in the appropriate courts in the Commonwealth of Pennsylvania exclusively, and subject to the laws of the Commonwealth of Pennsylvania. Should there be a conflict between the laws of the Commonwealth of Pennsylvania and any other laws, the conflict will be resolved in favor of the laws of the Commonwealth of Pennsylvania. All federal, state and local laws and regulations apply. Winners acknowledge that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize.
6. USE OF DATA: Sponsor will be collecting personal data about entrants online, and e-mail addresses from entry forms in accordance with its Privacy Policy. By participating in the Sweepstakes and providing your e-mail address, entrants hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's Privacy Policy.
7. WINNER LIST: For the names of the Prize Winners, send a self-addressed, stamped business-size (#10) envelope to: Winners List- ASC/ “Chance to WIN $100,000” Sweepstakes, 300 State St., Suite 402, Rochester, NY 14614. Winner names will be sent after selection of Winners.
